TERMS

1. Platform Role

Brand My Dick ("BMD", "the Platform", "we", "us") is a satirical advertising platform and 3D ad-space simulation for entertainment and parody purposes. A bidder pays to place a competitor's logo on a designated zone. Clicks on that logo go to the bidder, with a Brand My Dick referral. BMD operates solely as an intermediary platform. We do not create, control, own, endorse, or have any affiliation with the brand names, logos, trademarks, or any other intellectual property uploaded by users.

2. No Affiliation or Endorsement

All brand names, trademarks, logos, and trade dress displayed on this Platform are the property of their respective owners. Their use on this Platform does not imply any affiliation with, sponsorship of, or endorsement by the trademark owners. BMD expressly disclaims any such association. The content is user- generated and presented in a satirical, parodic context under applicable fair-use and free-speech protections.

3. User Responsibility

By uploading content to the Platform, you represent and warrant that you have the legal right to use the submitted material, or that your use constitutes lawful parody, commentary, or fair use. You agree to indemnify, defend, and hold harmless BMD, its operators, and affiliates from and against any claims, damages, losses, or expenses arising from your use of the Platform, including but not limited to intellectual-property claims from third parties.

4. Content Review and Moderation

We reserve the right, but assume no obligation, to review, screen, or remove any content at our sole discretion and without prior notice. Approval of content does not constitute legal clearance or endorsement. Individuals or entities may request removal of their name or likeness by contacting us directly.

5. Payments, No Refunds & Outbidding

All monetary transactions are processed through third-party payment processors (Dodo Payments). You pay 100% of the bid amount to secure and claim a placement spot on the 3D model. Payments are for active digital ad placement and entertainment services. Your placement remains active until another bidder outbids the current price to take over the spot.

All payments are final and non-refundable. If you are outbid by a higher bidder, you will NOT receive a refund — you paid for the period your placement was live. In general, BMD does not offer refunds, credits, or compensation for any reason, including but not limited to being outbid, voluntary withdrawal, moderation or removal, rejected content, payment errors, or change of mind.

By placing a bid you acknowledge and accept that outbidding is a core mechanic of the Platform and does not entitle you to any refund, credit, or compensation. Outbid payments are considered fully earned for services already rendered. BMD is not a party to any private commercial arrangement between bidders.

6. Limitation of Liability

To the maximum extent permitted by applicable law, BMD and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your access to or use of the Platform. The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.

7. DMCA and Takedown Requests

If you believe that content on this Platform infringes upon your intellectual-property rights, you may submit a takedown request with sufficient identifying information. We will review and respond to valid requests in accordance with the Digital Millennium Copyright Act and other applicable laws.

8. Age Restriction

This Platform is intended for users aged 18 and older. By accessing or using this Platform, you affirm that you are at least 18 years of age and have the legal capacity to enter into these Terms.

9. Modifications

We reserve the right to modify these Terms at any time without prior notice. Continued use of the Platform following any changes constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. BMD reserves the right to initiate proceedings in any court of competent jurisdiction that it deems appropriate.
